Summary 

The Swiss Federal Council recently reviewed rules for banks that are systemically important, and adopted the Report on Banking Stability of April 2024, which stressed the need to improve the current too-big-to-fail regime. This briefing dives into a specific proposal: the Senior Managers Regime. This new system aims to make individuals within these banks more accountable for their management decisions.

The speech will focus especially on

  • The proposed Senior Manager Regime in Switzerland with the aims to increase the individual responsibility within the financial institutions. This will highlight the possible impact on Senior Managers at the different levels of responsibility and management.
  • The current Swiss Legal Framework and the comparison with the UK Regime.
  • Evaluate the possible challenges of such implementation in Switzerland.
  • The opportunities and risks of the Senior Manager Regime

Keynote

  • Eric Stupp, Partner at Bär & Karrer
    Eric heads Bär & Karrer’s financial services department and co-heads the internal investigation and cross-border proceedings team. His practice focuses on advising banks, insurance companies, asset managers and other financial intermediaries on regulatory matters, enforcement proceedings and on M&A transactions.
    In recent years, he has regularly advised financial institutions and regulatory bodies in connection with internal investigations on cross-border issues. In particular, he has assisted clients in numerous proceedings initiated by the US Department of Justice, the New York Department of Financial Services and other US or European authorities.
    Eric Stupp is a regular speaker at expert conferences addressing these matters. He was a member of Bär & Karrer’s management committee for eight years. He is the vice-chairman of the board of directors of Goldman Sachs Bank AG, Zurich and a member of the boards of other financial and nonprofit institutions.
    IFLR 1000 2016 and Who’s Who Legal 2015 list Eric Stupp as one of the leading banking lawyers in Switzerland. Eric Stupp is listed as a leading lawyer in The Legal 500 in the category Hall of Fame. In 2018, the Weizmann Institute of Science awarded Eric Stupp the Doctor of Philosophy honoris causa for his professional achievements and his support of scientific research carried out in the Institute.

Swiss Risk Association in Romandie

The Swiss Risk Association (SRA) is a non-profit organisation and open forum for risk management. Through events, discussions and knowledge transfer, the SRA strengthens Switzerland’s position as a financial competence centre.

The Swiss Risk Association was created 10 years ago and was mainly covering the Swiss German Part of Switzerland. In order to expand our organization within the French part of Switzerland, we created a new Chapter “Romandie”, which was successfully launched last year. As part of the development in the Romandie, we are excited to bring an unforgettable evening and exclusive networking opportunities at the CRO Circle Dinner. This new event format has been a great success in Zurich and therefore, we are excited to have one of such prestigious event in “Romandie”.

The goals of the Romandie Chapter are to develop the exchange of knowhow and networking opportunities via the organization of Chapter Event covering various Risk topics, in the areas of Private banking, asset management and commodities trading etc.
